Die Teilnahme an der Auktion erfolgt mit der Anerkennung und vorbehaltloser Annahme vorliegender Auktionsbedingungen:
1. GEBOT
- Die Abgabe eines Gebotes bedeutet eine verbindliche Offerte.
- Der Bieter bleibt an sein Gebot gebunden, bis dieses entweder überboten oder von der Auktionsleitung abgelehnt wird.
- Gebote Unbekannter können von der Auktionsleitung zurückgewiesen werden.
- Nicht anwesende Personen können der Auktionsleitung Steigerungsgebote schriftlich mitteilen. Diese Gebote gelten als maximale Gebote,
zuzüglich Aufgeld in bar. Änderungen eines schriftlichen Gebotes bedürfen der Schriftform; sie müssen spätestens am Freitag, 31. Mai 2019,
18.00 Uhr vorliegen.
2. VERSTEIGERUNGSOBKEKTE
- Die Objekte werden im Namen und auf Rechnung der Einlieferer angeboten und verkauft
- Die Swiss Auction Company AG und die Verkäuferschaft lehnen jede Gewährleistung für Alter, Herkunft, Zustand und Qualität der zur
Versteigerung gelangenden Fahrzeuge und Objekte ab. Die Objekte werden in dem Zustand verkauft, in welchem sie sich zum Zeitpunkt des
Zuschlages befinden.
- Sämtliche Objekte sind an der vorausgehenden Ausstellung zu besichtigen. Es besteht die Möglichkeit, sich über deren Zustand und Wert ins
Bild zu setzen und zu informieren.
- Die Beschreibung der Objekte erfolgt auf Grund des letzten aktuellen Kenntnisstandes nach bestem Wissen und Gewissen. Das Swiss Auction
Company AG haftet nicht für offene oder verdeckte Mängel.
3. ZUSCHLAG/EIGENTUM
- Das Objekt wird dem Meistbietenden zugeschlagen. Das Objekt wird erst nach vollständiger Bezahlung an den Käufer ausgeliefert.
- Der Zuschlag kann unter Vorbehalt erfolgen: d.h. Liegt ein Gebot wenig unter der vorgegebenen Limite, so kann der Auktionator das Lot für den
Bieter verbindlich «unter Vorbehalt» zuschlagen. Die Swiss Auction Company AG wird Rücksprache mit dem Einlieferer nehmen und den Bieter
zu einem späteren Zeitpunkt über sein Gebot informieren.
- Bei Differenzen zwischen zwei oder mehreren Bietern kann das Objekt noch einmal ausgeboten werden.
- Ist der Zuschlag erfolgt, werden keine Beanstandungen mehr zugelassen.
4. ZUSCHLAGPREIS/KOSTEN
- Auf jedes ersteigerte Objekt ist ein Aufgeld von 22% zu entrichten. Für das Schiff gilt 12%.
5. BEZAHLUNG DER STEIGERUNGSOBJEKTE
- Die Bezahlung der ersteigerten Objekte muss bis am Montag, 10. Juni 2019 erfolgt sein. In Bar oder auf unser Konto bei der St.Gallischen
Kantonalbank.
- Jeder Käufer wird vor dem Verlassen des Auktionssaales gebeten, im Auktionsbüro die entsprechenden Formalitäten in Empfang zu
nehmen und eine entsprechende à Konto Zahlung zu leisten.
6. AUSLIEFERUNG/ABHOLUNG DER STEIGERUNGSOBJEKTE
- Die Auslieferung der ersteigerten Objekte erfolgt erst nach der Auktion und nach vollständiger Bezahlung.
- Die Objekte sind bis am Montag, 3. Juni 2019 abzuholen. Spätere Abholung ist nach Vereinbarung mit dem Auktionshaus bis zum 15. Juni 2019
möglich.
- Die Objekte, die nicht fristgerecht abgeholt werden, werden zu Lasten des Käufers ausgelagert.
7. RECHTSFRAGEN/HAFTUNG
- Die Swiss Auction Company AG behält sich das Recht vor, Änderungen und Hinweise bezüglich der Objektbeschreibung vor und während der
Ausstellung oder bis zum Zuschlag hin anzubringen. Sobald der Zuschlag erfolgt ist, können keine Mängelrügen mehr zugelassen
werden.
- Die Swiss Auction Company AG, als Verkaufskommissionärin gemäss Artikel 425 ff OG, handelt für Rechnung des Einlieferers. Jede Haftung für
Mängel ist nach Massgabe von Ziff. 2. wegbedungen. Allfällige Mängelrügen, Wandelungs- oder Minderungsansprüche sind direkt an den
Einlieferer als Verkäuferschaft zu richten. Kein Vertreter bzw. Angestellter des Swiss Auction Company AG ist legitimiert, davon abweichende
Garantieren abzugeben.
- Die Auktionsleitung kann ohne Begründung ausserhalb der numerischen Reihenfolge Lots anbieten, sowie Katalognummern vereinigen, trennen
oder zurückziehen.
- Jede Teilnahme an der Auktion erfolgt auf eigenes Risiko. Bei Beschädigung ausgestellter Objekte ist der Verursacher haftbar.
- Jede Wegschaffung der ersteigerten Objekte, auch durch Dritte, ist mit eigenen Kosten und Risiken verbunden.
- Die Rechnung der ersteigerten Objekte ist gemäss Ziffer 5 zu bezahlen. Wird dies versäumt, kann der Versteigerer wahlweise die Erfüllung des
Kaufvertrages unter Verrechnung eines Verzugszinses von 1% monatlich auf den Zuschlagspreis plus Aufgeld und der Kosten für das Inkasso
verlangen. Er kann aber auch ohne Fristansetzung oder sonstige Mitteilung unter Annullierung des Zuschlages vom Kaufvertrag zurücktreten
und das Objekt freihändig veräussern. Der Ersteigerer haftet in diesem Fall für alle aus der Nichtzahlung oder Zahlungsverspä­tung
entstehenden Schäden, insbesondere für einen Mindererlös. Eine eventuell geleistete Anzahlung wird auf den Schaden angerechnet.

- Die Versteigerung und sämtliche daraus resultierenden Streitigkeiten unterliegen dem Schweizer Recht und der Beurteilung durch die St.
Gallische Gerichtsbarkeit, unter Vorbehalt des Weiterzuges an das Schweizerische Bundesgericht in Lausanne. Dies gilt ungeachtet des
Rechtsdomizils der beteiligten Parteien.
- Für die Beurteilung von Streitigkeiten ist die deutsche Fassung vorliegender Verkaufsbedingungen, rsp. Auktionsbedingungen massgebend.
- Der Gerichtsstand ist Degersheim, Kanton St. Gallen.
8. ALLGEMEINES
- Die Versteigerungs- und Verkaufsbedingungen werden jeder interessierten Person bekannt gemacht und sind während der Ausstellung und
Auktion im Auktionssaal angeschlagen.
- Zum Mitbieten und Ersteigern eines Objektes sind Formalitäten, Name und Adresse des Käufers erforderlich. Das Registrieren berechtigt zum
Bieten.
- Es ist Sache des Käufers sich gegen Risiken von Verlust, Diebstahl, Beschädigung und Zerstörung der betreffenden Objekte durch Abschluss
einer Versicherung rechtzeitig zu schützen.

Participation in the auction is subject to the acceptance and unconditional acceptance of these Auction Terms and Conditions:
1. BID
- The submission of a bid means a binding offer.
- The bidder remains bound to his bid until it is either outbid or rejected by Auctioneer.
- Bids of unknown persons may be rejected by Aucion House.
- Persons who are not present may notify the Auction House in writing of any increase bids. These bids are considered as maximum bids, plus
premium in cash. Changes to a written bid must be made in writing; they must be received by Friday, 31 May 2019, 6 p.m. at the latest.
2. AUCTION OBJECTS
- The objects are offered and sold in the name and for the account of the consignor.
- The Swiss Auction Company AG and the sellers disclaim any warranty for the age, origin, condition and quality of the vehicles and objects put
up for auction. The objects are sold in the condition in which they were at the time of the auction.
- All objects are to be inspected at the preceding exhibition. It is possible to get an idea of their condition and value and to obtain information.
- The objects are described on the basis of the latest current state of knowledge to the best of our knowledge and belief. The Swiss Auction
Company AG is not liable for obvious or hidden defects.
3. KNOCKDOWN/PROPERTY
- The object is awarded to the highest bidder. The object will only be delivered to the buyer after payment has been made in full.
- The knock down could be also with reserves. If it is called up «... with reserve», it means, that the Auction House can first consult with the seller
and afterwards will inform the buyer, if his bidding was successful or not.
- In the event of differences between two or more bidders, the Object may be offered again.
- Once the bid has been accepted, no further complaints will be accepted.
4. KNOCKDOWN PRICE/COSTS
- A premium of 22% must be paid on every object auctioned. For the boat 12% will apply.
5. PAYMENT OF THE OBJECTS
- The auctioned objects must be paid for by Monday, 10 June 2019. In cash or on our account at the St.Gallische Kantonalbank.
- Before leaving the auction room, each buyer is requested to take receipt of the relevant formalities at the auction office and to make
an appropriate account payment.
6. DELIVERY/COLLECTION OF THE OBJECTS
- The auctioned objects will only be delivered after the auction and after full payment.
- The objects must be collected by Monday, 3 June 2019. Later collection is possible by agreement with the auction house until 15 June 2019.
- Objects that are not collected on time will be removed from storage at the buyer's expense.
7. LEGAL ISSUES/LIABILITY
- The Swiss Auction Company AG reserves the right to make changes and comments regarding the object description before and during the
exhibition or until the bid is accepted. As soon as the bid has been accepted, no more notices of defects can be accepted.
- The Swiss Auction Company AG, as sales commissioner according to article 425 ff OR, acts for the account of the consignor. Any liability for
defects shall be excluded in accordance with section 2. Any notices of defects, claims for rescission or reduction must be addressed directly to
the Consignor as the seller. No representative or employee of the Swiss Auction Company AG is entitled to issue any guarantees deviating from
these.
- The auction management may offer lots outside the numerical order without justification, and may combine, separate or withdraw catalog
numbers.
- Any participation in the auction is at your own risk. In the event of damage to exhibited objects, the causer shall be liable.
- Each removal of the auctioned objects, also by third parties, is connected with own costs and risks.
- The invoice for the auctioned objects is to be paid in accordance with section 5. If this is neglected, the auctioneer may, at his discretion,
demand fulfilment of the purchase contract by charging a default interest of 1% per month on the hammer price plus surcharge and the costs of
collection. However, he may also withdraw from the purchase contract without notice or other notification and cancel the knockdown and sell the
object by private contract. In this case, the successful bidder shall be liable for all damages resulting from non-payment or delayed payment, in
particular for any loss of proceeds. Any down payment made will be deducted from the damage.
- The auction and all disputes arising from it are subject to Swiss law and to the judgement of the St. Gallen Court, subject to appeal to the Swiss
Federal Supreme Court in Lausanne. This applies regardless of the legal domicile of the parties involved.
- The German version of these Terms and Conditions of Sale, rsp. Auction Terms and Conditions, shall be authoritative for the assessment of
disputes.
- The place of jurisdiction is Degersheim, Canton St. Gallen.
8. GENERAL

- The auction and sale conditions are made known to every interested person and are posted in the auction hall during the exhibition and auction.
- Formalities, name and address of the buyer are required for bidding and auctioning an object. Registration entitles the buyer to bid.
- It is the buyer's responsibility to protect himself against the risks of loss, theft, damage and destruction of the objects in question by taking out
insurance in good time.en.
